Terrified of losing children 😞

Okay here's my story any advice please...
I'm private renting, our landlord is evicting us for 2 reasons...
he's selling (no argument ofcourse I understand he needs/wants to sell)
ground 13- we have deteriorated the condition of the property (this one I'm arguing here's why)
We have lived in the property for 10 years, we have had many structual repairs that needed doing, I approached the landlord who told us that due to us not ventilating property it's caused the damp and mould.
I went and bought dehumidifiers, opened windows etc... cleaned all the mould off however the mould would always return!
I called environmental health round an improvement notice was served to the landlord, he was advised of every repair that himself as a landlord needed to fix!
However this was not followed up as the envirmental health officer at the time passed away.
However the landlord was still aware of the problems and chose to not do them!
I contacted environmental health again recently as the damp, mould and other issues were still not resolving no matter how much we cleaned the mould or using a dehumidifier.
A new improvement notice was served to the landlord.
He has now issued us with a section 8 notice using grounds 1a and 13 :(
Again I'm not arguing that he needs to sell, but ground 13 I find extremely unfair as most of the condtion of this property is down to him!
He is now also increasing our rent :(
Ofcourse there are days we forget to open windows and we don't always keep the home to a high level of cleaning, I have depression and anxiety (have done since my son passed) my partner is autistic our 4 year old is autistic and I have a typical teenager!
If we're found to be intentionally homeless due to ground 13 the council won't help us and we are passed to social services which could mean we lose our children :(

Because I've read that because my parents house would be overcrowded social services wouldn't see this as suitable accommodation

Where??? Did you read this total nonsense??

How often do SS remove children rather than work with LA to accommodate the family when there is no abuse or neglect?

Literally never. They can't! There is no lawful basis to do so

I would hope that it is incase they can support you in anyway. How awful if not. Hope you are out of TA soon

Thanks. We have just somewhere and waiting to move in within the next month, thankfully.
fresh start and no one will know the address. BLISS!

I thought so. OP needs to either calm down and look for help or ask for someone to advocate on her behalf .

Yay! Happy for you! I remember the feeling when we moved into our home. Safest and best day of my life.
We have lived here for 11 years now. Just the other day I went through my tea towel/cloths drawer. I had to keep the first cloths I bought for this house - couldn’t bear to throw them away. We had no beds, no furniture - just kiddies furniture and an electric single hob - not even a fridge so we kept stuff in the shed as we moved into our home in Winter! Hard at the time but we look back at that time with pride that we coped. Didn’t have a tv or curtains so me and my 4 dc sat on this kiddie furniture playing board games every night 🥰
Sorry about that - just sent me down memory lane! We ate toastiest or pasta every night 🙈
I hope your new home is amazing and your safe haven where you will build many memories! 🥰

charM89 · 16/08/2026 19:17

I'm sorry if I've annoyed anyone I don't mean to :( I haye anxiety I truly do there's so many horror stories on the Internet so ofc I start to think this will happen to me and my children

All I know is I love my children and I will literally take anywhere that will accept us in private rented

OP posts:

If we're found to be intentionally homeless, my ultimate scenario would be me and my children stay with my parents until we can figure out our next move.

Again, you are catastrophising. You won’t be found to be intentionally homeless. Dont waste your energy on scenarios that aren’t going to happen, save it to advocate for your family. Gather all the support you can.

Tbh I'm being told the section 8 notice is invalid

I understand ground 1a is mandatory as he's selling, but what's not to say the judge will look at ground 13 first and decide eviction based on that ground?

well done for coming through those times!
that must have taken guts and strength. Children get you through it don’t they. I hope you are so very proud of yourself! You should be proud well done❤️

Heretohelp1111 · 16/08/2026 19:39

You’ve had lots of sensible advice here that should reassure you that it’s highly highly unlikely you would be deemed intentionally homeless and if that did happen you would have support for your children to remain in your care. Unfortunately your anxiety will not let you hear or accept that so you’re going to be stuck in a continuous cycle of seeking reassurance from others in an attempt to soothe yourself, but not being reassured. What you really need to do is seek cbt as soon as possible if you aren’t already having it.

You will get through it too - and you will all look back and laugh on so many things that you didn’t laugh at the time. I promise you. Good times are ahead. Hope everything goes well in your new home x there is nothing like moving in and shutting the door knowing you are all safe. Best feeling in the world. Xx
If SS do get in touch, likewise dc schools then use their resources and advice and help. We moved in without a bowl, a plate or cutlery. People want to help - but you have to let them in. Feel free to message me if you need support

I think I'm understanding...

Social services have the power to place me and my children in emergency housing as they encourage families to stay together. As long as there is no neglect or abuse (ofc there isnt) then a child won't be taken

They could place us in a b and b, hotel, hostel or a small flat which could be out of the area.

Yes.
Except it's not to do with 'encouraging families to stay together' it's to prevent children sleeping rough or in unsafe environments.
If children have absolutely nowhere else to live because their parent cannot obtain accommodation, they have a duty to provide accommodation. This means somewhere for the children to live with a parent, not foster care.

charM89 · 16/08/2026 22:01

leavesinthebreeze · 16/08/2026 18:21

It doesn’t sound right because based on what the op is saying it won’t happen

What do you mean sorry? What doesn't sound right and won't happen?

Its the council that puts you into temporary accommodation not social services.

Oh yes. But thats extremely unlikely. As i said you have 2 lots of proof from environmental health. It could possibly he seen as a revenge eviction.

Relief duty is where the council try to secure housing via the private sector. Thats normally withing 56 days. After that the council ends their Relief duty. They them confirm homelessness and they have a full duty to house the family. This could be socal housing or private renting.

So after my relief period ends "if" I'm intentionally homless and the council don't have a duty to rehouse us, then it goes to social services?
They will then either allow us all to stay with my parents (even if overcrowded) or they will find us emergency accommodation which will hopefully be for us all?

I have already answered this several times. I understand perfectly what you mean, and you are just wrong.
Even if social services are informed that you are evicted, they will do precisely nothing unless they are told by you or by housing that you are presenting as homeless with your children. If you do that, they will advise you to go and stay with family. They won't give two shiny shits how overcrowded you will be. If you had literally nowhere to go, they would accommodate you with your children under section 17 funds in some b and b somewhere temporarily. Nobody is taking your children into care.

Im a SW and have commented twice already upthread- I literally do not know how else we can spell it out any clearer
