personal injury/belongs claim

i have suffered a injury and a item of value was damaged it was quite alot of money. The companies insurance asked for a quote i have given them one. my injuries are still on going. can The insurances pay for my items to be repaired whilst i am still recovering. I seem to think as my item and injury can be resolved separately. Any advice please i don’t have a solicitor

I am going through a personal injury claim at the moment. My accident was 15 months ago and it’s not resolved. That’s using a solicitor. To be fair it’s taken that long as my injury is still ongoing and I am still seeing specialists and physio. If you don’t want a solicitor acting for you then you need to research and be aware of how making a claim works. I didn’t damage any personal belongings, just myself. Do you have evidence that your item was damaged due to the injury and the company being liable? I’d imagine original receipts will also be needed?

The companies insurance work for the company. They aren’t there to help you.

Yes, compensation for damage to items and compensation for personal injury arising from the same incident can be settled separately - the former would come under Special Damages and the latter General Damages. However, it can be complex if treatment for your injury remains ongoing, as Special Damages also includes reimbursement for things like loss of earnings and out of pocket medical care, which you would want reflected in your settlement.

Do you have legal cover included with your home insurance? Check your policy documents - it’s often included as an add-on and can be used for legal fees and representation if you need to take legal action, including in personal injury cases. If not, you should engage a personal injury solicitor - many will work on a no win no fee basis, and only require payment from your settlement when everything is concluded.

Read everything careful before signing. It is unlikely but they may ask you to sign something saying that that the payment for the damaged item is in full and final settlement for the entire claim.

it is a ring much gad to be cut off i lost a piece of gold and a emerald was damaged. i have had quotes and sent them. one of the insurers said it cant cost that much but the healers i gave been to have said to replace the emerald sbd the gold dies cost a lot. I was just wanting an answer but the actual case handler never calls just sends a email. i have asked the shops insurers to call me ,

i have gad a further email and it sags. we cannot deal with you. as advised we await your legal representative to contact. i don’t have one and don’t want one. can they refuse to deal with me

Thank you for your advice. I have now emailed their claim handler twice and he has just sent exactly the same answer. He cannot deal with you directly and respectfully only deal with a legal representative .
I have again tried to contact him and i cannot get through. I spoke to one of his colleagues and i said i as m thinking if logging a complaint because i am not getting any answers.
Does anyone know why he is saying this??

They can't force you to get a solicitor but probably are saying this to try and avoid having to deal with a complex case.

You can make a complaint to their governing body or get your own insurer to talk to them. If you still can't get through.

But no, you don't 'need' a solicitor. Though one would probably be helpful.
