Please can you help. This netmums put me in touch with womans aid 4 years ago. Which i was able to serve a non mol and occupation order i can not express my sincere gratitude.

This mums net has been a life saver for me.
Im really needing some help. Ive had a final order from the courts in st helens last August 2025 for the sale of the marital home to be sold immediately. On the final order it says I was immediately to remove my home rights. Which I havnt because my solicitor advised me not to do. The marital home is in ex husbands name. Im still in the marital home with my son who we share half parental responsibility
I have no say in the house price. The court order says that we were both agree on the sale price. Ive had no say. The ex has been in his own house for 2 years. There has been no time line on the court order. Im doing all the viewings. The ex is saying im not keeping the property tidy and it's up to me to upkeep the maintenance in the house.he has lowered it once and apparently it's getting lowered next week. But it's still all of his decisions. I keep the house very tidy and the estate agent says its always tidy for viewings. I carnt move on. The divorce has been finalised and my half is in this house when it sells. And the rest to him. The whole divorce and child proceedings have been going on for 4 years. I have no money left. I am on benefits. I have asked chat GPT and it suggested a D11 form. I am going to have to represent myself. The ex was removed partially 4 years ago from the marital home by the courts as I came on this life saving website. He absolutely is a controlling bully. I just want to move on xxxxxxxxxxxxxxx

@Lizzyclar is the sale of the matrimonial home involving the enforcement of a Financial Court Order that both you and your ex have agreed?

If he is breaching the order the courts take a very dim view and he could end up having to pay your legal fees if you have to instruct a lawyer to enforce the conditions of the FCO.

You really must speak with a family law lawyer asap.

The D11 does seem the way forward;
Enforcement: To ask the court to enforce an existing court order (e.g., if a spouse fails to comply with a financial order).

Yes the sale of the house is in the order. But theres no time frame on it. Ex has chosen estate agents and the marketing price. So this could go on forever. Its his last bit of control over me. Xxxxxxxx
