Hi, can anyone help

I set up a direct debit with sky but they didn’t advise me it takes a clear 14 days to set up, in fact on the call they said 3 times that it’s set up for the 2nd (4 days time)

the payment failed and I got a missed payment marker against my name on my credit file, I have been battlimg with sky for couple of months to get this removed from my credit file

do I have a case legally?

I can't imagine you'd have a case but I'm not a legal person. I can just see you didn't pay them what you'd agreed to pay them. Did you have anything in writing that says the direct debit will happen on a specified day each month?

I had a similar problem when i bought a phone on an interest free loan. I paid the missing payment and did get a missed payment marker on my credit history (actually two, the loan company got my account number wrong TWICE) but it made no difference at all to my credit rating and I am not rich.

No legal case no. But there is no reason they can’t reverse the entry on your file, and they shouldn’t have logged one at all provided you paid within the month some other way.

When you say the payment 'failed', what do you mean exactly? If the DD wasn't set up then it can't have failed. Do you mean you missed your first payment because you weren't aware you needed to make it manually?

The DD documentation will have confirmed the start date, regardless of what you were told. I expect when they told you it was set up for the 2nd, they were referring to the date it was set for moving forward.

Did you make the payment in the end?

Ask them for their formal complaints procedure. There should be a recording of the call which should clear up what you were told re your first payment.
