Overpaid financial remedy

We were due to receive X amount from our LA as a financial remedy as a result of a formal complaint (about SEND), however they have made the payment today and it’s more than stated in our complaint response.

Do I contact them and find out if it’s a mistake and potentially pay back the extra or should I keep the extra set aside, not spend it and see if they ask for it back? Does anyone know where I stand legally?

Usually I would contact and sort immediately but in this case after all we have been put through any extra compensation is welcome. (Also the complaint has been escalated further in case it’s relevant but this payment isn’t because of that)

How much more? It could be interest accrued? But yes contact them they will either tell you it's right and you keep it or it's wrong and you give the extra back. Either way you are no worse off than you thought you would be.

My first thought is interest - if they accept the "fault" occurred some time ago they may pay interest on the award (8% is standard in financial services so may be similar here)

Contact them and ask

Ok thank you. I didn’t think of the possibility of interest, I just assumed the figure they put in the response would be the total.

I think I’m more annoyed because I’ve complained about multiple mistakes and law breaking, then they messed up the complaints procedure and now another (possible) mistake and it’s me that has to run around after them, using my time and fixing things.
