I'm looking for advice on my next steps, it may be long so I do apologise and I have NC just incase.
DCs EHCP was due to be renewed in September 2025, contact should have been made by LA in June 2025 per their own records and confirmations. I was contacted in November by someone who said they were my son's case worker wanting to book a review. I've had previous issues with the LA year after year including, taking them to tribunal and them not issuing a new EHCP for over a year so due to this the LA had agreed that any and all changes would be communicated with me and DC prior to being actioned.
This wasn't the case and as a result I had some questions that the LA gave excuses for but held no actual accountability/sincerity on their part as soon as I made it clear I wanted everything to be in writing and not accept a telephone conversation things started to go downhill.
The LA scheduled a date for a review which I couldn't do they're aware I have school drop off/pick up and only offered those times despite knowing they're not suitable, despite me saying no to the initial date they rescheduled it for the same day and time and told me "it will be going ahead on this date" a further 10 times each times with me telling them it wasn't suitable. I raised a complaint around their conduct, they kept misspelling DC name, lack of communication prior to new case handler and contact, case worker said they were "new" however took DC case 8 months prior and since DC last review had 8 different case handlers who none had stuck to prior agreements of the previous complaint and stated that due to the complaint being a conflict of interest, the concerns I have regarding their behaviour and refusal to listen etc I'd like for DC case to be passed to someone else and I didn't want any further contact with these two people.
The LA dismissed the stage 1 complaint context stating they refused to acknowledge anything outside 12 months despite information only coming to light after they got into contact ( I had to register for their online system in December changes to case worker etc happened months prior so I was unaware) and that they had lots of cases, said sorry so as the law said they had to be finalised by February they don't have much time.
I escalated this to a stage 2 complaint and had no contact from them until I contacted them at the beginning of the month due to receiving an automatic email from them saying "you failed to turn up for an EHCP review so your views will be recorded as unable to obtain" I immediately queried this as there had been no contact from the LA and they responded denying any EHCP review had taken place, despite this when logging onto the online portal the "proposed EHCP" was visible and wanted my views reordered on it. I recorded my views in every sections stating that that I wasn't party to the meeting because I wasn't informed and the EHCP proposed was out of date and full of incorrect information. 14 days later they remove all my comments and published EHCP with no communication from them again this review was signed by the initial case worker despite management confirming she wouldn't be in the meeting her manager would.
Upon investigation their are chunks missing from the online portal regarding the December meeting, as well as admissions made by the case worker as well as the meeting when clicking into the meeting links details the original December date not February,
I composed a timeline of events that had happened to date and submitted it to the LA to update the stage 2 complaint and within hours was served a "warning letter" from the LA accusing me of being aggressive and demanding to the director of the department affecting their wellbeing this was fabricated any communication from me was factual, formal and reviewed prior to being sent by another person to ensure this.
They then stated they were putting my complaint on "hold" despite it being 33 working days into their 20 days review when I finally got their response days later it was full of their "investigators" opinion on me and how it was my fault and based of that opinion of me why she wasn't upholding my complaint, she even included statements like "you could see DC case handler had changed when it changed so it's not being considered" this was despite her "reviewing the evidence" which showed clearly I couldn't see that as I hadn't held an account, she claimed things like they "don't have to refer to/use/spell DC legal name correctly because case worker was being informal and familiar" despite never having contact before. They've removed siblings from his EHCP and claimed he's 7/8 as well as much more like ignoring all my evidence submitted, conducting interviews with the staff but not speaking with me, accusing me of refusing to engage yet lists my engagement as aggressive etc. They refused to acknowledge the concerns regarding data amendment and the latest EHCP plan being incredibly wrong as well!
3 days ago I got a call from social services stating that the person/s handling the stage 2 complaint has raised safeguarding concerns saying DC "has not been seen or spoken to by anyone in any professional standing since 2020/21" this is of course a lie the LA have issued him 4/5 EHCP in that time, a blue badge, been to the house to see him, GP visits etc including the day prior. the worker I spoke to was horrified by what they've done and confirmed that he can see clearly that they saw and spoke to him last year. They closed the case and told me to absolutely contest this as it was wrong for them to do and I have raised a complaint regarding this, however today I received contact from another department from the council as the same people have now questioned the education DC receives and is wanting a review conducted despite the department having nothing but praise from the LA prior to this every year! This department have stated they have no concerns personally.
This person has caused an incredible amount of stress and turmoil to the point I have had to be taken of my cardiac beta blockers to be put back on anxiety medication. I need to know what I can do going forward, I am having panic attacks continuously about the situation now, it's effecting my family and my ability to function well significantly the LA are aware I am registered physically disabled, ASD, ADHD, and have various MH conditions
