Please help regarding online divorce tick box problem

I have filed for divorce online with my husband. I think we have made a mistake with the application already!

We both ticked financial order for ourselves but didn't tick our children.

Our son is 18 and in full time education and he is considered when we have agreed the split. So I had an inheritance which I will be keeping to help support our son through uni. So I am on lower income but will be taking around 65% of total pot (of which 15%) came from an inheritance that I paid our mortgage off with.

So my son is a factor in the percentage split but we will be having a clean break and husband wont be paying any maintenance going forward.

Obviously our d81 form and consent order will explain about our son and reasoning for the split of assets.

So should I have ticked our children box or not? I emailed them and they didn't advice but said I could withdraw the application and start again. Don't want to do this unless I have to from a time point of view but they didn't advise if I should have ticked the box or not!

Any advice would be greatly appreciated as I feel like I have fallen at the first hurdle.

Is child maintenance part of the consent order? If not, I’m not sure why you’re worried about this. You’ve reached agreement and it doesn’t include child maintenance. If it’s included in the order then there will be no obstacle to the judge making the order.

This doesn’t matter at all. Not ticking the box doesn’t prevent you from bringing a claim for your son but it sounds like you might be in agreement anyway, which means it won’t affect it. Just file your consent order and D81 at the relevant time (including any provision for your son) and it will be fine!

Thank you all, I thought that would be the case. As it's not ongoing child maintenance I think it is not going to matter. It was frustrating as I messaged them and they said I could withdraw the form but wouldn't give any advice as to if I needed to tick the box. Thankfully we are getting the consent order drawn up and seem to be in agreement so hopefully no more hiccups!
