Are judges really this clueless?

Went to court today regarding a work tribunal. The judge didnt have any of the evidence we submitted previously, took my copy of my legal points document I had so when the defendant spoke and I was asked if I had any questions I couldn't refer to my evidence. The judge allowed the defendant to give evidence that contradicted the submitted evidence and made dishonest representations, when I highlighted this and advised the judge that the defendant just mentioned he has evidence that hasnt been submitted this was not checked. In fact the judge didnt even understand what type of employment contract I had and kept asking the defendant to which he provided inaccurate info. At the end we wasn't allowed to even speak. Paying all the court fees was pointless. The judge doesn't even refer to actual points in law and doesn't even refer to evidence. In the end the judge announced that the defendant was a credible person and case dismissed. Small claims. Dont bother! The judge doesn't even know the law you're there complaining about. Im not complaining we lost. We lost for no reason that was related to the evidence or the actual law.

A friend of mine had a stressful small claims against her business from a deluded woman, the judge didn’t read the papers, let the claimant change the value of her claim at every hearing (none of the claimed values being based on any evidence of actual loss), forced them to get an “expert” to opine (joint cost) only to find for my friend on the basis of a document that was in the bundle & drawn to his attention from day 1!

I’m a lawyer (thankfully not a litigator) and it really was like looking behind the curtain at the wizard of Oz - a truly woeful system in the lower courts.

Yes exactly. Its a worthless system!

bit of a sweeping statement. Do you have expertise that qualifies you to make that comment ?

You may be able to appeal if the correct procedures weren't followed or you think there's been an error in law.

I've had a similar experience where the judge took everything the other party said as gospel despite them having no evidence to back it whereas anything we said was dismissed even though we did have evidence and it was all very biased.

I witnessed this today arrogant and clueless tick.. not sure about the over paid part.

Did you appeal?sorry to hear this happened to you too... although after what I saw today I'm not surprised one bit!

Im trying to appeal ... surprise surprise I need my form signed by the judge.. when we asked him he said I quote "stop speaking to me" . I've emailed the court to ask for guidance on how I get the form signed.

I don’t know about overpaid but I know 3 and their arrogance is staggering. 2 are/were DDJ’s and I worked closely with both in private practice. The other was a FWB

No I felt too traumatised! Plus the outcome would have been an apology at best so it didn't feel worth the hassle (or cost of engaging a solicitor).

I feel traumatised as well to be honest. Came home and am still in shock... not at the loss but what happened! I have been reading its best to get legal help with an appeal and I cant afford that but let's see how I get on with this form but if it doesn't get signed Im going to leave it there.
