Gifting money to myself and siblings with a deputyship order

I am a deputy for my Fathers estate. Unfortunately he is now in care for life. He is very happy and settled in a wonderful, private care home. We are selling his house and using the funds to pay for his care. However, he only needs a certain amount to secure his care in the home for life. He will have more than enough money to live on, for the rest of his life, with pensions and other savings. Once the house is sold there would effectively be around £70k left which should technically go straight into his bank but I think it’s a shame me and my siblings can’t have it. It won’t make any difference at all to him and will just go on more care home fees. Has anyone been in the situation and had the money? I know there are strict rules around deputyship but I know he would rather we had the money than it go towards more care home fees.

It would be deprivation of assets.

Why should social services (ie us the general public who pay taxes) pay for an extra year care home fees so that you can have a cash pot? Why would you think that’s ok??

Social services will not pay the fees they will take you to court to reclaim the money you have stolen.

You have completely misunderstood how it works.

All the care home is saying is if he has been there for at least two years as a private funder then WHEN he drops into the local authority funding threshold they will accept the local authority rate rather than kick him out.

The local authority don't just take your word that he doesn't have any money left they scour the accounts checking that money hasn't been hidden from them and if it has they charge you as if he still had the money and if you don't pay it they take you to court and inform the police.

Yes I am privy to his will. I have taken his prognosis into consideration and included the specialist treatments he receives. This money will go straight to the nursing home or it could go to us and it would make no difference, if it would change a single thing about his future I wouldn’t even consider it. Capacity is a tricky one as he can express exactly his wishes but he won’t speak to any professionals (although he will speak to me in front of his nurse). He’s actually chosen this home and made other important decisions but unfortunately I can’t really prove it and he really just wants me to deal with it.

This isn't a loophole it's just theft.

The OP (if not on a wind up) will find that out very quickly of they go through with their plan. Probably on the otherside of a police interview desk after a local authority safeguarding referral for financial abuse.

I am going to pose the question to my solicitor too but was curious as to whether someone had found a way to divert the money, without breaking the law.

OP assuming you are in England, it's very clear that you have no understanding of how the care system works.

The Local Authority will only pay care home fees if the person's savings and assets, including their house, drops below £23,250. You are saying that there is sufficient money to fund your father's care and then saying he's going to drop below the funding threshold after 2 years.

Once he drops below threshold his care is paid for by the taxpayer. You are suggesting stealing £70k of your dad's money and leaving the tax payer to fund his care.

Ermmm, yep, can’t really deny it. Most of us will have our fees met by the tax payer if we end up in a nursing home for more than 5 years.

Jeez , I suspect you can’t wait for him to pop his clogs so you can get your hands on his money … I bet you hope it’s sooner rather than later so you don’t have to pay so much in care fees and you get more for yourself .

No we won’t. The majority of people won’t end up in a care home, and of those that do, most fully self fund.

If social services take over funding, your father may still have other private expenses e.g. paying for for hairdressing/clothing/chiropody etc

If you have a record of the thousands you've spent personally, you may be able to repay that. But make sure every penny is accounted for.

Are you sick in the head of something? He is in a care home because he did nearly die. I’ve never had any money off him. I’ve done everything financially on my own (as it should be) and I’ve worked my ass off the last year, providing for him financially and emotionally, I would rather he spent every last penny travelling the world and buying super cars but he can’t- I merely taking about using money that will be taken by the care home.

Yes he will have all those expenses and more. They are covered by seperate money, although I have paid them over the last year (I have kept receipts etc) I wasn’t particularly interested in claiming that back as he would have done it for me.
