Hi all. Please can someone give me some advice. Myself and ex have court order in place for our 6 yr old daughter. There are holiday provisions within this that state I have to give passport to him 7 days before any holiday and give him a consent letter when he tells me of his holidays with a timeframe.
last year I forgot to do both and he messaged to say I had breached the order twice. I promised I wouldnt breach again but have forgotten again this year to give passport and consent letter in time. this didn’t hinder their plans as I gave it to him the morning he picked her up.
im worried he will report the breaches.
anyone got any experience of this and if the courts would still be heavy considering this has nothing to do with the contact they have?

Did he ask you to do the letter and give you the passport? For example, 'we're going away on 20th, so I will need the passport and consent letter when I pick her up on 11th'? Or did he just expect you to remember?

No he just let me know the dates they would be going away. Court order tells me what I have to do in that instance which is to provide consent letter and passport and I know he will say the onus is on me to remember what the court order orders me to do.

I suggest that the biggest risk is if you dont comply and they cant travel.

That could expose you to liability for compensation.

Its pretty straightforward, get your life admin sorted.

As a one-off it's likely nothing to worry about, especially considering it didn't affect the holiday plans.

However, he has every right to report the breaches as part of an ongoing pattern of breaching the court order on your part. This will not look good for you should you end up back in court over a variation of the order at any point.

'Forgetting' is a frankly unacceptable excuse - You should look to put something in place to prevent this happening again. Perhaps your Ex or a third party (grandparent, etc) holding/transferring the passport.

Hi all just an update for anyone in similar situation as ex did report the breaches. I received a fine so definitely worth making sure you review court order and understand it completely
