Changing child’s name by deed poll (unenrolled)

Good afternoon

I am trying to change my son’s name by deed poll (unenrolled). I am only changing it to add in my surname. I have his father’s consent in writing. We both have parental responsibility but our son lives with me under a Child Arrangements Order and has supervised contact with his father (as a result of him harming him as a baby).

Does anyone know if it will be accepted that just I sign the deed poll? It’s impossible for me to meet with him and have an independent person witness both our signatures. As I have his consent in writing and our situation is more complex, I’m hoping that it will be accepted but I’m not sure.

Any help gratefully received. It’s causing a lot of worry as I just want my surname to be included in my child’s name. Thanks so much

Have you considered speaking to Citizen's Advice? If they do not know themselves they may be able to signpost to someone who does.

You should sign it with two witnesses and get him to sign it with two witnesses. You don't have to use the same witnesses or sign at the same time.
