I’m taking legal action against my former employer for long term disability discrimination.

They have told me that they are “very keen on settling” but have never sent an offer, not even in the early days of the claim. We’re at disclosure now, if that helps.

Why could this be? I assume it’s a tactical move, but I can’t understand why they haven’t sent on offer to get the ball rolling etc.

They may be hoping that you will respond with an offer to settle, telling them how much you want, in the hope that you will give a low figure.

@prh47bridge Ahhh. Thank makes a lot of sense. I thought it was a tactical move. I haven’t sent any offers either, and I don’t mind if we don’t settle.

I have been wondering if they’ll send an offer, since they asked for my Schedule of Loss etc.

Did you respond to say you are open to this and you await their offer?

The court will have asked you to produce and share you schedule of loss, so yes, they might be waiting for this before making an offer.

The respondent’s barrister asked for my Schedule of Loss, which I sent to them two months ago. However, they haven’t sent me an offer yet!

I say yet, I’m obviously not sure if they ever will send me an offer. I just thought it was interesting, and whether it’s likely a tactical move on their part?

You'll just have to wait and see. If you've a half decent case it's unusual for them not to make an offer.

Love to know the outcome of your case. I’m in the similar boat. I was asked if I am open to settle but then not heard anything else since. My hearing date is next week. I wonder what games these people are playing?
