Eviction/possession order/section 21

Hi everyone,

A couple of days ago I was served court papers with the accelerated possession order so the papers sent with a defence paper work to send back.

my landlord missed out thr section 21 she hasn’t sent one. She didn’t include it she has said she has but she hasn’t. I approached her and she said to lie about it just like she had and then said to seek legal advice which I’m not being silly here but I’ve been told it will just Invalidate the eviction because paper work is missing and we both will be in a situation no better off.

I don’t know what I need I just need advice and guidance I suppose off people who have been through this because I hate the private rent property that I’m in etc and I know that I’ll end up in temp accommodation.

i just don’t know why my landlords being difficult with section 21 do the council ask for all the paper work do they check everything like what happens. It should be a court order without a hearing. Do they ask to see the section 21 or do they just take the possession order if it’s granted.

Sorry you are going through this OP. You should be entitled to early legal advice who will be able to help with defective s.21 etc

Its very unlikely that a possession order will be granted if your landlord hasn't served you with a section 21 notice or filed it with their claim, regardless of whether you file a defence although I would advise you to.

Losing your home is considered to be very serious by the Courts and they do not order possession lightly.

Possession action is in scope for legal aid funding if you meet the financial eligibility so you should seek legal advice.
