Respondent not complying with case management orders

I’m going through the employment tribunal process.

I was supposed to receive correspondence from the respondent’s solicitor by a specific date. However, I’ve not been sent this correspondence. This is the second time where they have not complied with case management orders. They were a day late for a previous deadline.

Is the employment tribunal likely to do anything about it? It’s so frustrating because I always ensure that I comply with what I have to do…

The tribunal can order the respondent to pay you expenses if their failure to comply has caused you to spend time chasing them. A severe case of non-compliance can lead to their defence being struck out. However, the tribunal is unlikely to do anything about a deadline missed by one day.

Write to the tribunal and explain the situation. Highlight any hardship it’s causing you e.g an inability to progress the case. Ask for an order to require them to comply with the case management orders and copy the solicitor for the respondent into the email. That should get them moving!
