Ccj or payment plan?

I have been chasing a tradesman for months to complete a job that I paid a hefty deposit for upfront (more fool me). It's clear that he won't be turning up so I'm now instead chasing for a refund of my deposit.

He's been fobbing me off for months and has now finally admitted he doesn't have the money and already has one ccj against him.

I was about to file my own claim but what would be the best way of going about this now he's come clean - he's offered a payment plan to repay me which I am open to, but does this mean I'm not protecting myself legally? Should I just file for a ccj anyway? Not sure of the best way to go about this to maximise my chances of getting any money back!

Lbc has a lawyer on sat and Sunday at 9 pm they r good at getting you legal advice.

Having a payment plan does not stop you going to court later if he doesn't stick to it. Personally, if the plan is reasonable, I would accept it. But make sure you get it in writing.
