Hi everyone,

Thanks for your help on my original post!

We were at court today and the debtor didn't turn up so that along with his insufficient evidence meant to judge refused to set the CCJ aside.

I am now considering if I should try and recover the money. It's just over £1.5k which would obviously be very helpful but also we aren't sure if he may become violent/aggressive if we proceed.

My husband doesn't believe the hassle he could cause is worth it. I feel like he put me through a load of stress bringing it up again after 4 years and maybe he should have the stress now.

I do believe he could fully pay the debt if someone told him too but I think he's (successfully) managed to bully most people into not pursuing getting money back.

Any advice on how to go about getting the money back? If it's worth trying to get it back? What we can do to protect ourselves if we do try to get the money back?

No he definitely won't pay willingly, he's had 4 years and hasn't paid a penny.
