I have had an ongoing conveyancing nightmare for 2 years. The current chapter of this saga involves working with the owner of a neighbouring flat.
I cannot sell my flat because there is no lease plan and my neighbours lease plan shows his flat to be where mine is. We each need a deed of variation to submit to land registry.
it took my solicitor 4 days to get a draft plan back from a draftsman., a further 3 weeks to get the deed of variation drawn up from land owner's solicitors and 4 weeks to get it signed by all 3 relevant parties.
It has taken the neighbour's solicitor 7 months to get a the draft plan. Well, he says he has it bit I've lost all confidence. My solicitor has requested a copy, recognising we have no right to this but he keeps addressing other matters in her emails but not this. He is totally evasive. She has also asked him who is funding the legal costs for the plan and deed - mine was about £1400. Again no acknowledgement of this question even to say mind your own business.
I'm suspicious that this law firm acted for my neighbour in the purchase of the flat and perhaps he sought restitution for the blatant lease plan oversight when he bought his flat. I think the firm may be footing the bill for the deed and are therefore stalling.
Is this stalling and lack of transparency something that could be reported to the solicitors regulation authority? I can't complain to rhe firm or thr ombudsman because he is not my solicitor. I will be in same position this time next year and I can't take it any longer.
