Child maintenance

Sorry if this is not the right place but can I do a FIU (think it’s called that) with child maintenance without any evidence? I know for a fact my ex is lying about his income but don’t have any physical evidence. I’ve been told mixed things, can they check his bank account?

No you can’t.

The CMS can refer cases to FIU where there are credible, evidence-based challenges, but the FIU do not take referrals from a receiving parent without any supporting information.

It doesn’t necessarily need to be evidence but it needs to be credible supporting information, so if they were self employed and you knew they had 2 sets of books you can say that, or if you can show their lifestyle doesn’t reflect the income shown so if they claim they’re on 12k a year but are living in a 500k house, driving a brand new Range Rover and have annual holidays to Dubai or the Maldives as an example.

Even then though the FIU don’t just check bank account, they can access other HMRC records and investigate to look for additional undisclosed income.

Ah thanks that’s what I thought anyway so not sure why people have told me otherwise, annoying, it’s rental income which isn’t declared but I can’t prove it he just admits it verbally (and I’ve witnessed it) but no physical evidence.
