I don’t want to out myself so will try and put as little as I can on here but really need to speak to someone who knows the law from both HR point of view and legal one.

I will try Acas on Monday as citizens advice wasn’t really helpful and hopefully a no win no fee solicitor. I was so sick on Thursday and Friday and really couldn’t speak as my voice was literally gone. It still is but much better.

is there a way I can speak to someone on here for advice without putting my situation on this platform. I feel like I could have a case for discrimination and bullying.

Thanks

How long have you worked there, and was the dismissal linked, directly or indirectly, to a protected characteristic?

Bromptotoo · 29/09/2024 13:40

ACAS are usually pretty good but really you need a lawyer who specialises in this stuff and possibly, depending on the circumstances, your area of work.

BarbaraHoward · 29/09/2024 13:41

Sorry to hear that OP. I can't offer advice, but just remember that anyone on here could say anything and you have no idea if they're really who they say they are.

Understandable that you're beside yourself and want to talk today, but please take your advice from the experts, not MN.

Best of luck whatever way things go. Flowers

Unfortunately only started 3 weeks ago.

part of issue was so blatant for others to see that they advised me to speak to HR. But speaking to HR meant I questioned them and therefore do not fit in their culture and values.
I believe I was bullied. But tried not to rock the boat. But it backfired.

GotFiredAndStruggling · 29/09/2024 13:48

Oh I think it was directed whether indirectly at me being a different culture. It was horrible.
I was literally made out to be a person I am not. Everything mentioned in there I had no idea where they got it from.

If you have only been there three weeks your rights are limited. What outcome are you seeking, it sounds as if continuing to work there is not sustainable.

Lupeypoon · 29/09/2024 13:53

As you've been there fewer than 2 years you don't have a leg to stand on unfortunately. Employers can sack employees without following any kind of process before the 2 year mark - they shouldn't, but legally there is nothing to stop them. The exception would be if you were fired due to a protective characteristic.

Cut your losses and move on.

GotFiredAndStruggling · 29/09/2024 13:56

I’ve been fired so I will not be nor would I want to work there. The manager is a misogynistic……. And made some really derogatory remarks towards another colleague when she wasn’t in the office.
I am aware that I don’t have any rights due to my limited time there.
I am also aware probation can be ended with no reason given. However they gave a reason. And their reasons are blatant lies. I left a job to take this job and now have this on file. Yes only 3 weeks but I still need to mention lack of gaps if left off as previous job will only confirm their dates.

They got me so upset that I didn’t realise until Friday night that I drove home half blind as my glasses were still by my desk. So I need to contact them for that and I really cannot face them.

You mention you being a different culture. Were you dismissed due to your race, religion, ethnicity or your sex? If so that is a protected characteristic and is potentially one of the very few reasons you may have an unfair dismissal case.

Otherwise you don’t.

DannSindWirHelden · 29/09/2024 13:59

Nobody is going to even notice a couple of months' gap on a CV, so don't worry about that.

You're hinting at some sort of religious/racial/sex discrimination which might give rise to a case, but it might not be worth the bother of getting into a fight for such a short term job. Talk to ACAS.

GotFiredAndStruggling · 29/09/2024 14:01

Thank you. Will speak to Acas tomorrow and see. I am of course trying my best to apply for other jobs.

Staunchlystarling · 29/09/2024 14:02

Op you can just leave it off your cv. No one notices 3 weeks.

im afraid with three weeks unless you’ve evidence, then it will be impossible to win any form of suit or complaint. I’d focus on finding a new job.

you’ve been there 3 weeks you
will likely get no where with this.

speak to acas by all means but don’t waste your time.

MeMyCatsAndI · 29/09/2024 14:07

You've been there 3 weeks, you have no protection to being fired until 2 years. You really won't get anywhere with this.

Focus on getting a better job.

Mrsttcno1 · 29/09/2024 14:09

I’m sorry OP but after 3 weeks this is a complete dead end. Focus on moving on to something else

Absolutely this. Legal action is unbelievably stressful and even if you did get some kind of payout (extremely unlikely) it would be miniscule. Cut your losses and move on.

StormingNorman · 29/09/2024 14:16

OP this isn’t going to go anywhere.

HermioneWeasley · 29/09/2024 14:20

Agree with others saying after 3 weeks it really isn’t worth pursuing.

LizzieBananas · 29/09/2024 14:20

Have you asked if your old job is still available? If you’ve not been replaced, could you go back or maybe reinterview for it at least?

Wonderingstar1 · 29/09/2024 14:24

It isn't correct you can't pursue anything at 3 weeks. You can't claim unfair dismissal but you have the right not to be discriminated from the start and through the application process.

LBFseBrom · 29/09/2024 14:26

You can explain an employment gap by saying you needed a break and wanted to look around for something different. A lot of people do that so don't worry.

I am so sorry about your sacking, op. Life is unfair sometimes.

Things will get better.

I wish you much good fortune in the future.

This

Is it really worth the stress and upset of a tribunal case. You were only there 3 weeks and it sounded awful anyway. Probably better to just put it down to a bad experience and move on.

sunsetsandboardwalks · 29/09/2024 14:31

You've only been there three weeks - you won't get anywhere.

Just leave it off your CV and look for another job, it's just not worth the stress.

This. There is protection from day 1 of the application process against discrimination but even if you were successful in bringing a claim, would you want the stress of a case hanging over you given how limited any compensation is likely to be.
This is likely to be what Citizens Advice told you but if you want peace of mind then an employment solicitor would be able to advise. If you have a LawWorks branch in your area you may get lucky and get a free opinion.

If you believe that you were bullied due to your ethnicity then it really doesn't matter how long you had been there you may have a legal case
BUT I could tell you that I am a HR expert or Employment lawyer and you would have no idea if that was true (its not) so please do get proper advice
