I don’t want to out myself so will try and put as little as I can on here but really need to speak to someone who knows the law from both HR point of view and legal one.

I will try Acas on Monday as citizens advice wasn’t really helpful and hopefully a no win no fee solicitor. I was so sick on Thursday and Friday and really couldn’t speak as my voice was literally gone. It still is but much better.

is there a way I can speak to someone on here for advice without putting my situation on this platform. I feel like I could have a case for discrimination and bullying.

Thanks

Unfortunately only started 3 weeks ago.

part of issue was so blatant for others to see that they advised me to speak to HR. But speaking to HR meant I questioned them and therefore do not fit in their culture and values.
I believe I was bullied. But tried not to rock the boat. But it backfired.

Unfortunately until you've been anywhere 2 yrs u have no rights, and 3 week in you're still in your probation period, so even easier to bin you off. Sorry to be the bearer of bad news

liverpudcounsel · 29/09/2024 17:56

OP you will be unsuccessful with a “he said/ she said” case. You need hard evidence.
As you have only been there a few weeks, cut your losses forget about the lawsuit and move on.

I have had many people contact me for representation jn employment tribunals, I decline the majority as a lot of the bullying cases are flimsy at best.

There is no point in speaking to acas. Honestly it's just wasting your time and theirs. That horrible company you worked in will close ranks and lie to make you look bad. You cannot win in these circs.

So cut your losses.

You could register with a temp agency or ask your old employer if your post has been filled and would they like you to come back on a temporary or even permanent basis. Or take any job just to pay the bills until you get something better.

Sorry you're going through this. It sucks. But one day those bastards will get their comeuppance.

My experience with ''no win no fee'' solicitor is they charge you double fees if they win but may not tell you in advance. This was a large London firm and I did not proceed as I lost confidence in them.

You do have to be told in advance, don't you?

Also I thought fees under conditional fee agreements (no win no fee) were capped at 25% of whatever compensation you are awarded?

If you enter into a no win no fee agreement with a solicitor and you then back out against their advice, aren't you liable to pay their fees and expenses to date? Backing out of a NWNF agreement is daft.

Also if they win and your fees are 5000, but you win 500, you still need to pay them 5000. Because you won and the fees are due,

As per my previous post, I thought fees under conditional fee agreements (no win no fee) were capped at 25% of whatever compensation the court or tribunal awarded you.

Am I wrong?

Let me clarify
I added at the end that some work places are like that.
There are some beautiful women in top positions who are the best at their jobs.
However, I talk from experience where sometime you walk into a company and see a male boss who only ever hires young pretty women.
It happens.
Not sure why my comment bothered you so much.
It still happens today.
Literally the other day, I was sat in a restaurant and the boss told us that all his workers are hot and he likes looking at them.
It happens.
At no point did I say that beautiful women only get positions because of their appearance.
I simply said that some companies hire beautiful women only.

Yes, for some companies, the op needs to read the contract.

CFAs and DBAs are two different things.

No win no fee = fees + a success fee (tends to be no cap, but the fee is a % of the fees charged)

Damages based arrangement = a % of the fee. Capped depending on type of action.

The loser pays the winner's costs, generally, but the loser doesn't have to pay any success fee.

Daniel Barnett. He’s a Barrister.

I bet Barnett would say Don't waste your time, which has been said repeatedly on here. Just because you can, doesn't mean you should.

Why bother, life really is too short, there are a lot better things to do with one's time

Gymnopedie · 29/09/2024 20:51

However they gave a reason. And their reasons are blatant lies.

Presumably lies about a protected charateristic would be easy to disprove, so I doubt that would be one of their reasons. That takes away the one area the OP might have a claim.
