Court date on holiday

Ex has finally taken me to court for contact with the kids. Which I'm not disputing just want it in a contact centre due do violence and he's not seen them for a good while.

Got our 1st court date but it's when we've got a holiday booked and family wedding. We booked it in November of last year. Non refundable.
Will the court move the date? Court is already costing thousands I can't afford to loose this too.

You need to write to the court including proof of the booking and ask for the date to be changed. Quote your case number. If you call the court helpline, tell them the court and they will be able to give you an email address.

Thank you. Is it likely to be moved? Or is it just something they don't do

Yes it will be moved if you don't leave the request too late.

WomanFromTheNorth · 27/08/2024 19:07

Yes they can move it.

i moved a date when i had free use of a friends caravan for a few days. i had no booking but sent the whatsapp co firming things with my friend, a copy of my annual leave request with work showing it pre dates the letter arriving and a screen shot from my diary. was no problem at all.

KittenOnTheTable · 27/08/2024 19:54

Yes have all info proving it was booked last year. It's a big holiday for us anyways including a stay in legoland hotel so would be very sad to miss that.

Yes it's likely. It's down to the discretion of the judge but should not be an issue with plenty of notice.

Youthiswastedontheyoung · 27/08/2024 23:37

I asked for family courts to move the date as I was due a baby - they said no. Left fighting for my sons 5 days pp 😢 Also told under NO uncertain terms I must not cry as that would make me look weak.

KittenOnTheTable · 28/08/2024 00:36

That's horrific! I'm sorry that happened to you. I was in court 13 days after having my youngest giving evidence against me ex for domestic abuse it's fucking hard. They did offer to move the date though I didn't want to I just wanted to close that part of my life

Hi. Did you just emailed the court or do you make a C2 application?

PollyBell · 23/06/2025 09:29

It would be better and give you more time if you contacted the court and asked them asap we could all give different answers

QLR · 23/06/2025 09:35

@Iamvictorio i just emailed the court and attached my evidence. was very straight forward.
