My daughter has been through an awful divorce. She has had a terrible time trying to get money which was agreed for their children. Instead through the CMS her money has gone down and down. We know her ex husband is lying and jumping through every loop hole he can find. I would like to know if anyone has had a success story regarding the CMS?

It depends what “legal loopholes” he’s taking advantage of. She can apply for a variation with the CMS asking for assets and other income beyond employment income to be considered when calculating his payments, if it’s her belief that he has significant wealth beyond his declared income. Whether she’s successful or not will depend on the evidence available: it needs to be beyond “I think he’s lying about his income because he’s a liar.”

Thank you for your message - yes we realise we have to fund more evidence but can be so difficult. Lifestyle tells such a different story.
