I have just ended acas early conciliation with 2 respondents due to disability discrimination.
One respondent would not engage or settle as they blamed the other respondent. The other respondent agreed to give me my job back as part of an EC settlement. I did verbally agree to this, with a view to proceeding to tribunal with the other respondent, however just before the EC process ended. I was presented with information from the respondent who would not engage which had been with-held from me for months and only came about at the very end of the EC process. This information if it had been presented to me earlier would have meant I would have brought proceedings a lot sooner and would not have entered into the agreement I did with the other respondent.
ACAS subsequently issued two EC certificates and I submitted a claim against both but I have since been told that as i had agreed a settlement with one respondent, it is now legally binding and my claim will be thrown out and also the respondent could take legal action against me for backing out of agreement. It is a stressful mess!
Please can someone advise. As if going through 6 months of hell due to the discrimination wasn't bad enough. Now it is stress overload. As my entire case was based around both respondents being equally as culpable.
