Hi - In January this year I bought a used car on finance from a well known dealership after seeing it advertised on a new and used car selling website .
Noticed within a few hours that the DAB wasn’t working . Contacted the dealership who booked it into the garage for it to be looked at the following month .
Car goes into garage was told it needed a new Ariel and that the DAB “wasn’t switched on “and all should be good once new Ariel is fitted .
Car once again goes back into garage the following month , Ariel is changed and it’s then discovered that the car does not have DAB just a am/fm radio which is rubbish .

I have been in contact with with the dealership since who are not really helpful saying that the advert on their website did not state the car had a DAB radio but they can’t show me the proof of this as all adverts are archived once a vehicle is sold .

I’ve contacted the car selling website who sent me a copy of the dealerships advert from their website which states amongst the specifications the car has DAB radio . Dealership are saying that this advert is nothing to do with them , and the car selling website often adapt the adverts .

Does anyone have any advice please what my next steps should be or am I fighting a loosing a battle . Thankyou

TBH I think you're not going to win this.

VHF/FM can usually be made to work OK but it's in the nature of analogue radio that it goes mushy if the signal is poor.

Can you add DAB functionality at a cost? Can you use a phone either via a lead or Bluetooth to receive radio?

If the car has Android Auto or similar functionality it's even easier.

If the advert is archieved then it still exists - if it had been deleted then it wouldn't.

I would ask the 'selling website' for a copy of the original advertisement, as you think the car may have been mis-sold. I would expect the garage to have their own a copy of what they submitted but of course they can change it now to anything they like, so I wouldn't ask them any further.

Although like a previous poster has said, unfortunately I don't think you'll get the result you want.

A DAB radio can’t be retrofitted to the car . I could look into getting some sort of car play into the car at cost . Which is annoying as I bought a car that stated had DAB radio in the advert .
I have got the copy of the original advert from Autotrader that states DAB radio in the specifications , However the dealership are saying as it’s not the advert on their website it’s nothing to do with them what Autotrader post .

That's rubbish - about Autotrader embellishing adverts!

You could ask Autotrader but I'm sure they will say the text (and tick boxes) is what an advertiser submits. If not, then any creditiblity of Autotrader would evaporate and they would be open to legal challenges.

Autotrader states at the bottom of every advert “The data displayed details the usual specification of the most recent model of this vehicle. It is not the exact data for the actual vehicle being offered for sale and data for older models may vary slightly. We recommend you check the vehicle details with the seller before you buy.”

You should’ve checked with the seller and checked the car at the point of collection.

So the real question is what the advert on the dealer's website said and what they said to you. If they claimed DAB was fitted, they must now either supply and fit DAB, or give you a price reduction. If they refuse to do either, you could take them to the small claims court. You will, however, need evidence of what they said. As @TwoLeftSocksWithHoles says, archived and deleted are different. If they archived it, they still have it. However, as they are being unhelpful, I would use the Wayback Machine (archive.org) to see if they recorded the dealer's website with the advert.

I have contacted the dealership again who say that they can’t access the original advert, or send me a copy of the original advert but they can tell me that the original advert did not state DAB .

I have tried way back machine which doesn’t have this years adverts on .

A disclaimer cannot override the Consumer Rights Act. The car must match any description. So if the dealer says it has DAB, it must have working DAB.

Interesting that every dealer website has a disclaimer of some sort referencing specs and inaccuracies. Presumably the legal teams at all these big players seem to think they’re enforceable. There’s a difference between reading a fairly generic spec on a website and asking the dealer direct for the spec, I’d imagine if you asked the dealer for the exact spec by email and they replied that it had DAB then you’d have a case.

I have emailed main dealer for a copy of the main advert that was originally on their website and a copy of the full spec of the car . I’m not holding out much hope for a response as I have had to do all the chasing up .
Quick question if the car as they say did not state it had DAB -why would they give the go ahead for a new digital Ariel to be fitted to a car that had no DAB installed in the first place ?
The dealership booked this car in twice for the car to be looked at . This was at cost to them .

Quick check in Nissan's website shows models same age as yours with DAB radio integrated into the infotainment system but of course that might be trim dependent.

Is the handbook any use?

Otherwise I suggest an audio specialist or a Nissan forum.
