UC and Joint Tenancy any advice please?

Hi all,

My STBXH has recently moved out, so have changed my UC claim to Single claim. However, on my first statement they haven't included the housing element. At an interview I was told this could be because our tenancy is a joint tenancy.

I don't know what to do, I'm so worried how I'm going afford to pay the rent this month.

I'm also worried that after reading online he has to agree to leave joint tenancy. But if he does this I'm not guaranteed to secure a new tenancy agreement. I'm not really bothered if he is still on the tenancy if it gives me security of the house. Or will the housing association demand a new tenancy? And will UC flag this up to them?

My mental health is in a really bad way atm, struggling really bad even leaving the house etc without heart rate going over 150bpm. And this extra stress is tipping me over the edge.

I've never been in the situation before and not sure what steps to take moving forward.

Any advice is greatly appreciated xx

Your landlord will have a policy for tenancy breakdown.
It's more difficult if you are a secure tenant than an assured tenant but usually you can end up with a sole tenancy (whether by assignment joint to sole - for assured, him relinquishing his rights, or surrender and regrant for secure, or a court order in matrimonial/family proceedings).

Starting point is contact your landlord.

Not 100% sure on rules for UC - you might only get 50% award until issue sorted.

Put a note in your journal that it is an un tidy tenancy and that he no longer resides there. Make sure he has changed his address for council tax etc it will be reviewed and hopefully back dated to the date he moved out. Google untidy tenancy Universal Credit.
