Hi,

I’ve tried to google but I haven’t been able to find anything.

Background:

My ex and I have been split for a number of years and I have found out recently he was arrested and is on bail due to an allegation being made against him for recording sexual activity without consent - his phone etc was seized and if he’s found guilty he will be put on the register - I have no idea how long for.

Does anyone know if he’ll be able to still have unsupervised access with our child? And if he isn’t, will I be notified? I’m not sure how it works with the allegation being made by an adult.

I have no issue with him as a parent or concern around the safety of my child. I have no idea if the allegations are true but the problem is we live around 2 hours away from each other and he won’t speak to me about it at all.

i just need to know what will happen if he’s found guilty, so I can prepare myself

Thank you

The sex offender's register is a bit of a misnomer - there is no centrally held register. It is actually a system of notification. If he is convicted, he will have to inform the police if his contact details change. He will also have to inform them of any travel plans, any address where he has stayed for more than 7 days, anywhere he has stayed for at least 12 hours at a household or private place where a person under 18 was present, and certain other details. If he is added to the register, it will not prevent him from having unsupervised access with your child unless the courts impose a specific restriction, which is unlikely for an offence that does not involve a child.
