Non-molestation order application - query about exhibits

Hi all - as a follow up to my previous query about the length of the statement for NMO applications, I’m now asking about exhibits to support the statement.

Most of my exhibits are in the form of abusive text-messages that I’ve received from my ex. I have several examples of these messages and I’m not sure which ones to include as exhibits. Should I just just include the ones that I’ve reported to the police and have crime reference no.s for? In addition, is there a maximum number of exhibits that I can attach to support my application?

You need to include every message that is referred to in your witness statement. Do not include any message that is not referred to in your witness statement.

You can include a collection, for example if your witness statement says ‘I have asked him not to harass me via email but he keeps doing so, please see exhibit A’ and then under exhibit A I would add the messages showing what he’s been sending you with a date next to each one, put them in date order.

I would include as much as possible because ultimately you can’t refer to it during the hearing if you haven’t included it in your paperwork. Just make sure that you have mentioned each piece of evidence you’re putting in with the witness statement and then add the reference next to it.

I think mine was about 10 pages of exhibits (photos, emails, text messages). My statement was extremely thorough and clearly showed the pattern of abuse as well as how he had ignored all police attempts to contact him. All the hard work completing the statement and exhibits really paid off during the hearing.

Thank you @Mumof3confused & @prh47bridge . Mine is likely to be much longer than 10 pages of exhibits(!). Is there a limit to the no. of exhibits that you can have or did you format them in a particular way?

I’m not aware of a limit but I would probably not have too many pages, as the judge is expected to read it ahead of the hearing. You could say ‘here is a selection to illustrate point A - I reserve the right to submit future evidence if needed’ or something like that.

Thanks @Mumof3confused - My ex likes to rant on and do my text message evident runs on for pages and pages(!).
