SACUM-UK Trademark Help

Are you able to use a name of a product that is trademarked under the SACUM-UK agreement if the product isn't relevant to the trademark? For example, my products fall under category 14 (jewellery) but the SACUM-UK trademark in question is in the 'Class or category of product:Wine'. My product won't have anything to do with wine, so is that ok?

It isn't a direct infringement of the trademark but could still be classed as "passing off". If you want a definitive answer, you need to consult a lawyer who specialises in intellectual property.
