Rent bill after death

Hi everyone.

I've been dealing with my late father's estate and have just been given a rent statement from his landlord. He started renting from him around 10/12 years ago.

My father died out of contact with me and I didn't find out until recently. He died intestate so just me and my sibling to benefit from his estate. I'm the closest living relative and am taking care of everything including the admin.

Anyway on the rent statement there are charges for rent almost a month past when my father died. Is this normal/legal to do?

Also can I ask (demand if i need to) to see the original rent agreement thay my father agreed to as there is no mention I'm this final statement anything about deposits.

What I really don't want to do is pay the LL money that he has made up. The LL is already trying to extort me on another issue.

If he won't give me the proofs I need whay can i do?

Thanks

@rubberthedim

I would post your question in the ‘Residential Lettings’ Forum on

www.Landlordzone.co.uk

There are some very knowledgeable posters on the forum who know lettings law inside out. You will need to state if your late father was resident in England/Wales, Scotland or NI.

Don't pay anything unless you've been given and have thoroughly checked the paperwork for it. If he won't give you any proof, what can he do? With nothing in writing, he won't be able to go to any authorities for back up. You've got the money. He can't have it unless he can prove it's owed to him.

Is he harassing you?

I know when my Gran died we had to pay rent on her flat until it was empty & the keys handed back so it was paid for almost a month after her death.

A tenancy doesn’t automatically end when the person renting the property dies. Correct notice must be given - i.e. four weeks, by the person dealing with the deceased’s affairs.
