Transferring house from joint to single ownership

Hi - any conveyancers out there please?

DH and I own our house jointly. No mortgage. We want to transfer it from joint ownership into my name only (lots of reasons, all legal and sensible, financial advice has been sought!) No money will change hands and it will be exempt from CGT and stamp duty.

The only thing I'm confused about is whether we need to complete a TR1 or a TP1 form? Ie is it classed as a transfer of whole or part property? The .gov website is not very clear on this!

[I know we also have to submit AP1 and ID1 and a fee]

It’s a transfer of whole. A transfer of part is where only part of the property/land is sold/transferred. For example if you sell part of the garden.

It’s a Transfer of Whole, so a TR1 is needed. There’ll be an option to tick that it’s a transfer not for any money/monetary value, and the land registry will be a able to see that you’re transferring your husband’s share of the property to you and deal with it appropriately
