My friend has received an LBA regarding posts on social media. She has a draft response sent to her by a solicitor, but she has some concerns about it. Should she respond point by point to defend herself or just send a simple denial? She is worried she will be drawn into a never ending cycle of letters if she sends a lengthy response. However on the Gov site re pre action protocol it says to state why you deny the claims. In the draft letter it says my friend deleted all the posts & deleted her FB account, but I’m worried they will use it to say she is guilty. The solicitor hadn’t added a caveat to say she was under extreme stress at the time and it isn’t an admission of liability. I’m so worried about her. Her mental health has rapidly gone down hill since they started threatening her some months ago which is when she came off FB. I can’t see anything wrong with what she posted online. It looks like they are doing it to intimidate her. Any advice would be greatly appreciated.
