You need to seek solicitors advice

You've been through care proceedings already if they are now subject to a care order. If this was a while ago you can ask the children's SW to reassess your parenting IF (and really if) you have been able to make such significant changes to your functioning that you are now able to meet their needs but also manage the trauma they will have experienced too. So we call this needing 'better than good enough parenting'.

Are they with grandparents under SGO or under Care Order with the grandparents being connected persons foster carers? (sometimes known as kinship carers)

hadrianswallsycamore · 01/12/2023 21:17

Surely you would have been in pre proceedings for 16 weeks before they were taken so you had a chance to make changes unless something was really wrong and the children were in significant danger. I imagine you are finding this incredibly difficult but the time lines don't ring true to be honest.

bellac11 · 01/12/2023 21:24

MIght not have been in pre proceedings at all if there was a precipitating incident which led to separation

Nevertheless, there is clearly a long history here and if this has been in proceedings, which it must be if the children are subject to orders then all the assessments and reports will have been put to the court to demonstrate what OP needed, whether that has been provided, what difference it made to her parenting and whether she is able to meet her children's needs.

FLICKFLICK89 · 02/12/2023 05:57

No because there already on a care order so social services share half pr because as the care order was guna end ect but covid hit and its just gone from there

OP posts:
FLICKFLICK89 · 02/12/2023 06:03

There still on care order which social services was happy that they would go back to court and end the order as children where home happy everything was going brillant the covid hit so it delayed it I caught covid then month later admitted to hospital with suspected meningitis but said long covid ever since then iv had health anxiety and visits to a&e and ambulance coming out ect also had a abortion in June which I was ment to have the pills at 4weeks but they wanted me go hospital so made me wait till 4months so had a surgical abortion after that infection then pycosis from all the stress as it wasn't wat I really wanted if am honest and the guilt and trauma from all that made things 1000% worse

The timings are difficult to understand

You seem to be saying that the children were subject to proceedings around 5 years ago, resulting in a care order. A care order ends when the child is 18.

You seem to be saying that things improved with you and therefore the children were placed with you, still under care order, with a view for the Local Authority to seek to discharge the Care Order.

You're saying various delays prevented that happening and in the meantime, your health and mental health declined which raised issues about how you were meeting their needs?

And so now the LA have placed the children with their grandparents, presumably under connected persons as a fostering arrangement?

FLICKFLICK89 · 02/12/2023 08:31

Yeah this is what am saying

OP posts:
bellac11 · 02/12/2023 08:35

Ok, well yes, the LA dont have to go back to court and Im not sure a solicitor would be of help at this stage, the children are still under CO and the LA share PR so it is their decision where to place the children

Your focus probably needs to be on getting yourself well, having as positive contact with the children as you can, trying to support them to undo some of the trauma they will have experienced, building that relationship with them.

FLICKFLICK89 · 02/12/2023 08:38

This is exactly what iv been trying to do but with no support and help I had no other option to go to a&e as I was scared like really scared now the support is in place am hoping get well and get them home

I work for children's social services. The way to view this is that your children have been taken off you as their needs weren't being adequately met. You need to concentrate on becoming well and demonstrate that you will cooperate with SS. Speak to your MH team and social worker and ask what they expect of you and what support is in place to help you. Maintain contact as directed with the children and fingers crossed they will be able to come home.

Do you work in court proceedings/care planning?

Children cant just keep flitting from one carer to another, they need permanency.

OP may not have a social worker, she might have a MH worker if she is lucky but that is correct, she needs to focus on getting well and ensuring she has the best relationship with the children she can. It may not now be possible for the children to return to her again, it may be too traumatic or triggering for them and uncertain given OPs history.

FLICKFLICK89 · 02/12/2023 08:50

Thanks iv been trying and trying email social worker and so have other professionals to see what they expect of us and what needs to be done but there on a care order previous reasons years ago and then we got them back on a thinks it called placement with parents what my qualification is when am well will I get another chance as I definitely did asked for this and want this to happen iv asked for help for ages and its all been put it place now when to late but obviously not to late for.me to get well would they return home a second time is my question if everything is deemed fit for them to come home

OP posts:
bellac11 · 02/12/2023 08:54

Yes they will have been placed with you under placement with parents regulations.

In terms of emailing the children's SW to ask 'what is to be done', thats not the correct route. Your children are with foster carers (albeit relatives, which is a good thing) and presumably the care plan needs to determine whether that is a permanent placement for them. Children need permanency, they cant live with the idea that they might go back to mum at some unspecified time, and they will also have experienced trauma so that needs support for them

Your focus is on working with your own support services, your GP or MH worker to determine how your treatment is effective, what your care plan is and engaging with positive contact for the children.

FLICKFLICK89 · 02/12/2023 09:10

That's what I am planning on doing
