Who is my employer?

I work for a local authority school.
The advert was on the local authority website.
My contract, payslip, and pension all state the LA.
The school has a delegated budget and my costs come from that.
My post is a funded post from central government and put into the budget via the LA although I don’t think that’s relevant.

So is the school my employer? Or the LA ?

The LA. You have no contractual relationship with the school though they may line manage you.

No. Almost certainly the LA. I had a post funded by the government but was employed by my LA. All budgets are delegated to schools but only certain schools employ the staff, academies usually.

If payslip and importantly pension are LA, you are a LA employee. I’m assuming it’s not teacher pension scheme.

Any teacher employed by the LA is in TPS.

For maintained schools (i.e. community and VC schools), the local authority is the employer. For VA schools and academies, the school (or the body that runs the school - the academy trust, for example) is the employer.

Who is the employer and who exercises the employer's powers in schools has got very messy with one refroem on top of another back to at least the Major era. However, if your contract is with the Council then they are your employer.

Not true. Teachers at VA schools and academies are not employed by the LA.

I’m not a Teacher, I’m support staff.

It’s not an academy just an LA maintained school.

The answers are still the same, except you clearly won't be in TPS. For an LA maintained school all staff are employed by the LA.

All public sector roles are funded directly or indirectly by the government, but that doesn't mean that are all employed by them. it's only really the civil service who are direct employees.
