Booking.com smalls claims?

Middaymatters · 12/11/2023 10:41

In June I booked a villa in Greece through Booking.com. It was around £3,000. I paid via bank transfer from my online bank account. The day after I paid, my booking was cancelled.
I immediately contacted Booking.com who were very reassuring and told me not to worry, they would investigate. They could see that it was a fraudulent property that had advertised on their site so we were covered. They asked me to send them some details, proof of transaction etc. There began 4 months of hell.
I’d send them something, call a few days later and they’d want something else. Sometimes something I sent was in the wrong format (they’d want a PDF not a picture). They told us they couldn’t take it forward until our bank had tried to recover the money. We tried that. Our bank looked into it but couldn’t help and sent us a formal letter documenting this which we dutifully sent onto Booking. Com.
We are now stuck. They just keep repeating to us that either a) we haven’t sent them all the information or b) when we point out we have, they say it’s not in a valid format. They can’t specify what that format should be though.
We don’t know where to go next. Booking.com is based in the Netherlands so I’m not sure I can take them to the small claims court. Any advice? Thank you.

Obviously unhelpful, but this is why a credit card for transactions is vital. You would have got it back by now. I would give booking 3 working days to conclude the claim or you will take them to court. They work here so I'm sure you can still do that.

I know! Kicking myself now! I did read online (when trying to investigate small claims process) that my contract is with Booking.com (Netherlands) not booking.com Ltd which is the UK company so I’d have to Sue the Dutch company. I’m not sure small claims court works for foreign companies?

How did you manage to pay by bank transfer? They only give you the option of paying by credit or debit card?

I'm pretty sure I've been offered other payments options on booking.com before

Holiday booking scams are really cruel, this also happened to someone I know but I think that was Airbnb and I don't think she got her money back

Middaymatters · 12/11/2023 12:37

There wasn’t an option to pay by credit card or else I would I have done this definitely. I know I’ll never get my money back from the villa ‘owners’ but it’s booking.com that I’m trying to get my money back from. They take responsibility for the fraudulent advert and are ‘happy’ to refund me- they are just stopping my claim at every turn. I feel helpless! If there was any additional information I could provide, I would. So frustrating that Booking.com are making it impossible for me to
claim.
Does anyone know what steps I can take next? Can I use small claims for a non-uk company?

Have you reported it to the police? You can do so here: www.actionfraud.police.uk

I have paid with Paypal. So there are other methods.

I had similar in September- they made an error on a hotel booking. The hotel were great, booking.com refused to answer anything, failed to sort it out, it was Paypal who simply returned my money and took it from them. Paypal are big enough not to care about booking.com. I deleted my account with booking.com and I'm finished with them.

The times newspaper has a columnist that helps people with stuff like this

CatOnTheCludgy · 12/11/2023 13:31

Jill Insley is the journalist. If you email her she might be able to help.

Any luck with getting this refund? We are in a similar situation, but fortunately for a lot less £££

Middaymatters · 09/03/2024 09:19

Sorry! Only just seen this. We finally got a result just a couple of weeks ago. In desperation we asked our bank to write them a letter providing every possible detail we could think of related to the transaction. For some reason, this did the trick. Bizarre as we’d already provided them with all these details previously. Guess they just liked this format?

Took us 7 months and lots of stress but we finally got the money back. I wish you the best of luck with your case.

@Middaymatters Oh I'm so pleased for you! Our bank have sent us a letter to send them, so fingers crossed.

We are experiencing the very same nightmare you had……literally identical. Can I check what was the difference in the first letter from the bank and the second which worked? Thank you so much, Sam

Middaymatters · 05/12/2024 21:04

So sorry you are having the same issue. The first letter from the bank was just to confirm they were unable to recover our money. Booking.com wanted proof of our transaction but the standard statement from our bank wasn’t enough as it doesn’t contain the IBAN number etc. Our bank provided the full details they needed but sent it in an email which booking.com refused to accept. Eventually we went into our local bank branch and the kind manager wrote us a letter, on headed paper (which booking.com were keen on) which provided all the details they requested. This did the trick. I hope you can do the same and get your money back. I’d obviously never use booking.com again!
