Can he get granted child residency??

What are the deciding factors when they make a decision about child residency orders? I didn't think he'd go this far in trying to take the children from me, all because I asked for a divorce. He's tried to add the children to his UC claim twice and now he's made a claim for the child benefit so they've stopped my payments. I have a solicitor and also IDAS. I was going to put in an order for me and the children to stay in the house but I can't do that until I've got a child arrangement in place but I can't do that when he's living in the same house! My plan now is to get a residency order and move. But how easy is the process, do I need lots of evidence, will it go against me that I'm not getting the child benefit for them (no one is right now). I'm so scared

Child arrangement orders normally like to stick to the status quo, so if you are the primary carer, you'd get the lives with and dad will get contact with.

I'm not sure on the divorce proceedings element however.

I believe its 'lives with' on court orders, not residency. You could ask for lives with you but spends time with dad. Is he asking for shared care?
