Brother has been head hunted by a big UK employer for a very niche project. This will involve long overseas trips to some potentially dodgy places. Employer wants to employ him through an agency who have quoted a day rate. The work won’t be anything new for him but I worry the big UK employer have offloaded their liability if anything does go wrong (brother has previously been caught up in a civil war, kidnapped briefly, and required a group of armed guards while working in South America - all of which he came through unscathed).

My instinct is to advise my brother only to take the project if employer employs him directly, as then the employer has a duty of care; but legally is there really much difference?
