How long should I wait for promised refund?

DH & I would appreciate a little bit of advice with the following:

Our main car dealer recently agreed to refund us the money we paid for an extended car warranty which was mis-sold to us by one of their salesman. When we discovered this and brought the details of this to their attention, the Manager fully agreed with us and agreed to refund the money we paid. He has now stated to us twice that the money would be back in our account the next day, and yet still we have not received it.

How long should we wait before starting legal action to recover the money? We would be taking it to the small claims court rather than the Motoring Ombudsman as the refund has already been agreed. To be fair, it’s only been nine days, but as I said he has promised us the refund would be with us ‘tomorrow’ twice.

If you want to pursue this through the small claims court, you first need to send a letter before action. That would normally give the dealer 28 days to pay.

Personally, I would give it another couple of weeks before thinking about legal action. Just keep chasing.
