Mum has split from her husband due to dv and has accepted an offer on the marital home which is in her name alone . Since the split she has had to pay off outstanding bills and debts he left behind .
He is currently on bail and she is getting a non mol order in place but her upset has turned to anger and she is talking of spending the proceeds from the house so there is nothing left to split when a divorce happens .
I understand her view but I'm worried she'll end up in trouble if she does this .
Does anyone know whether she can take reasonable living costs out of the fund and what happens if she really does spend the lot .

Difficult to say what might happen. He might have the assets frozen before she can spend them. Once spent, she would need to prove they were spent only on living costs, otherwise she might find he gets 100% of what is left and maybe even be owed more than that on settlement.
