On 9th September I made an order from a Scottish company who sell top grade fish for delivery throughout the Uk. My order was to the amount of £100. Made the order, paid using PayPal, to be delivered on the 19th September, all good. Telephoned the retailer on the 15th to make sure it was all on track. Yes he said. It would be deep frozen lobster, prawns, crab meat.
SO looking forward to it!
On the 19th - waited in all day, no order delivered - emailed at 5.30 to report non delivery
On 20th - no ordered delivered, so I called retailer, no answer in the morning, called again at 5pm - no answer. Emailed - no reply
On 21st - Fedex called to say they will deliver my order, (ok, even though this was frozen fish, I thought I would get away with it by sharing it out with others to eat that day). The delivery never came. called retailer, no answer, emailed, no reply
To-day 22nd Fedex called again, at 8.30am, we will deliver your order today and I said I would refuse to take it as the fish would be rank by now. The person in the office said she understood and to 'leave it with her'. At 1.00pm the driver called to say he was on his way! I said I am refusing delivery, and explained that the food would be 'off'. I could hear him bibbing on his phone or whatever he was doing, he wasn't in front of me, maybe at the depot IDK.
So, who do I try and get a refund from, the Scottish retailer or Fedex.
I feel fairly certain the retailer will say they kept their side of the contract by giving the order to the courier, but the courier, Fedex, buggered up. What do I do to get my £100 back, shall I just raise a dispute with PayPal?
