Final court order

FamilyLawQuestion · 21/08/2023 12:35

A final court order was made regarding finances based on the expectation that 3 children reside with their other parent. However, family law court ended up with only every other weekend.

The parents are public service workers and have gov pensions which needed to be split 50:50, but this has not yet been resolved and when it does, is it still fair to be 50:50 since it was all based on a 50:50 split for the children. Had that not been the case before the final court order then I think the judge would not have aimed for 50:50 at all.

Is there anything they can be done for the pensions to make up for this or is it too late?

That’s a bit confusing. Pensions are usually equalised. There are a few exceptions. But if you both work and have pensions why wouldn’t they be equalised? Your lives probably won’t be equal going forward.

Not enough to make a difference. Who the children live with often makes no difference - both parents still need somewhere suitable, as they still do in your case.

It is assumed by some on MN that whoever has the children is entitled to more. That often isn't the case.

Okay, thanks for clarifying this.

I had expected if the Dc don’t stay with the other parent then they’d maybe be awarded a smaller house as no need for extra bedrooms.
