Swimming lessons refund?

Hi

I expect the answer is I'll just have to suck it up, but thought I'd post here in case I have any rights to a refund...

I wanted some 1-2-1 swimming lessons for DS. My parents live in a seaside resort with numerous caravan parks and leisure facilities. As I was unable to find any private lessons where we live, my DM arranged some with a teacher at the pool of a caravan park local to them for when we knew we'd be visiting them this week and next. She arranged this over the phone gave me the teachers name and account details and I transferred the money for 4 lessons on 30/06/23 (£100).

Today we went up to the pool to check if we just go straight in or need to report to reception etc, to be told by the pool staff that the teacher we'd arranged lessons with has left (was self emp and rented the pool from them for lessons, so never an employee of the park). They said they'd ask them to contact me, and gave me their number for if they didn't, but that essentially it was nothing to do with them.

I'm going to ring the teacher and ask for a refund, but do I have any rights regarding this that I could quote to encourage them to pay me back? It was arranged with my mum and the teacher over the phone, so there's both by in writing. I'm posting more in hope than expectation!

Thanks for any advice, and apologies for any typos, I'm using my phone.

If it’s a mobile number I’d consider texting so that you have something in writing

It doesn't matter whether you have anything in writing. You have a contract with the teacher (albeit unwritten) for 4 swimming lessons to take place this week and next. If they are unable to provide the lessons, you are entitled to a full refund.

You can take him to court for the amount if he doesn’t get back to you. Most companies won’t hire anyone with a CCJ.

The only problem with that is that I expect OP doesn't have an address for small claims.

But yes, you are entitled to a full refund. Do you have a name and can you trace them at all?

Where did your mum find the teacher? Where were the details advertised?
