Contractor failing to show up

Hi All,

Can anyone offer advice on where we stand legally with regard to a contractor who is not completing agreed work in a timely manner?

We got a quote for some work and asked that it be completed within 3 months. They didn't show up to start the work for two months and then said they would complete it one month late, which we agreed.

There was bad weather, which delayed things further. However, even when the weather improves, they didn't show up.

We are now 8 months (!!!!) past the original date agreed and the work is not complete.

Where do we stand in terms of payment? As a direct result of these delays, we will have lost significant income.

We have paid 50% already.

I have tried to get quotes from other contractors to complete the work but they have long waiting lists plus they are quoting us significantly more than we have left to pay as they say they will have to redo some of the work.

What can we do, legally?

If he completes the work, can we withhold payment?

Can we contract someone else and seek to get compensation through small claims court for the extra expense plus loss of income? Is it likely we would win? If we win, are we likely to see the money?

Any advice gratefully received.
