Separation Agreement

My husband and I have been separated for 6 months. I'm in the family home with the kids while we await sale. We have already split our savings in half. We will split the sale proceeds in half too. At the moment things are amicable in that regard, but I know I need to protect my half from him should he decide to gamble all his money away or lose his job. I understand a separation agreement would be wise. The only thing we are struggling with is pensions, we will need an actuary to figure that out.

Can we do a DIY separation agreement that says we each relinquish any claim to the others property or savings from now but that we will agree to establish a pension sharing order in due course, once divorce proceedings are underway?

For the courts to take a separation agreement seriously you both need to take independent legal advice and make a full financial disclosure. Even then, the courts will disregard it if circumstances change, or the agreement is not fair.
