I still own a garage with my ex DP

I sold a property with my ex in 2021. He was still living at the property so had most of the dealings with estate agents etc. I have just found out the garage was never included in the sale and so we both still own it. What can I do about this?

I can only assume he has either been using it or renting it. I haven't had any contact with him since the sale in 2021

If you can’t deal with him yourself you need to get a solicitor.

So what did the financial settlement say? If sale of property within division of assets, go snd see a solicitor. Was the garage outside any agreement? Hopefully you can sort out a sale but ex doesn’t sound trustworthy. Take closer interest this time.

How did you miss that you bought two plots of land did your solicitor not point this out at the time of purchase?

Or did the solicitor he contracted with follow instruction and split the original property into two new plots and only issue a sale contract for the house?

I would email him directly and ask what he knows about it (he might no nothing) and ask if he or the new owners or none are currently using it. Then see if the replies what he says, before getting lawyers involved as that will add up.

If for any reason it is too emotional to be able to speak with him get a friend to email on your behalf

Or you could look at land registry. See if there are details of any new owner. As this probably was excluded from the list of assets, I don’t see how legal advice can be avoided.

Thank you everyone. I have tried to reach out to him today but no response. Seems he has either changed his phone number or blocked mine. I have checked the land registry online & we are both still register owners. I contacted a solicitor who advised try & contact him through a mutual party and if not then call them back for a quote.

FYI, we were not married & this was my first experience of buying (and then selling) a property which I wasn't living in. He had main dealings with estate agents and solicitors etc so yes this is a lesson learnt on my part.

Well if there’s no divorce and declaration of assets then he really can keep things hidden. So how did you forget the garage?

You bought with A ?
You sold via B ?
You will be given a quote from C ?

so 1, 2 or 3

can you call the solicitor who did your end of the sale and ask if you can get a copy of the file for your own records NB Dont go into any detail just ask is it expensive and how long would it take to produce.
if you were a client of B you were owed a duty of care too.

How did you find out that the garage wasn’t sold along with the house? Are you near enough to see whether he is using the garage?

Private investigator to find him, get his address, then solicitor's can chase up your half of the outstanding asset value.

Bumped into an old neighbour around 6 months ago they mentioned they had seen him. Did not know he had any reason to be in that area as it is a very private block of flats with garages around the back. Had a hunch since then but I was heavily pregnant so didn't get into it! Checked the land registry today & yeah we still own it.

Start with the solicitor that handled the sale.

It may be that the garage was sold but only the land registry for the flat was sold. Is that possible?

Although your ex would then have had no business near the garage.

Have you got any paperwork from the sale?
