Help with car dealership "fraud" .

Hi all,

I have posted on AIBU so apologises for the double post but I think I may need some legal advice so will try and be as clear as possible.

Back in December 2022 I put a holding fee on a car of £100 which was refundable by the way, I gave them my details and we arranged to pay and pick up the car after the Christmas period unfortunately my funding fell through so I had to call and cancel it. They said yeah that's fine but kept my £100 but I didn't push for it as I felt bad for cancelling.

In March of this year I received a fine for not taxing this car and a V5C. I contacted the dealers and explained we had received the V5C and they apologised for their mistake and ask we send them a picture of the V5C and they will rectify the issue as they've sold the car.

We kept receiving demands for the fine and we called, wrote and emailed the DVLA explaining the situation and they wrote back today basically saying they don't accept it and we are responsible for the fine so I called the dealership to find out that we are still the registered keepers hence DVLAs decision. They have said they'll sort it out but I'm not sure how but for some reason they send me all the details of the new owner.

I don't really know what to do I appreciate mistakes happen however I'm not sure why are details were used before we bought the car but then they didn't rectify it the first time or back in March and I don't have much faith they will this time but basically:-

They kept the refundable £100
Registered me as the registered keeper without permission.
Sent me the new owners details (GDPR??)
Their mistake has caused a lot of grief and distressed as the DVLA enforcement are chasing us down and basically saying we're not being truth as we must have the car so are responsible for it.

I just don't know what to do and whether it may be worth speaking to a solicitor but thought I'd post here first.

Hopeful bump because I just don't see how someone can register a car in someone's name without their permission nor knowledge yet that person is then suddenly responsible for the car.

Whether you understand how this situation has arisen isn't really the issue - clearly an administrative error but one that unfortunately you do need to take steps to resolve as you will bear all the adverse consequences of not resolving matters - neither the dealer nor purchaser have as much skin in the game
