Legionnaires at work

Hi,

I have a family member seriously unwell in hospital at the moment with Legionnaires Disease. The consultant believes he contracted it from a jet washer at work (car dealership). He won’t be paid sick pay beyond statutory and will likely be off 2 months. Someone hasn’t done their maintenance/monitoring properly it seems. What are his chances at claiming injury at work?

I assume as legionnaires is a notifiable disease some investigations will be made, but will they go to the workplace unprompted, or will the workplace have a chance to flush the systems before HSE can check things over themselves to try and avoid getting into trouble?

any advice on the above please?

I dont work in a car dealer ship but where I do work we have to have legionella testing done bi yearly. And monthly temperature recorded. I would think your family members job would need to do similar. You should be able to find out what their requirements are fairly east. Then it's a matter of can they prove they have done so?
