Hi OP

We're going to move your thread over to legal matters now.

Someone may be able to make a reccomendation if you can say which court it's going to be in.

Nousese · 12/07/2023 20:14

Hi thanks,
It is in the family court at Bromley. This will be the 2nd hearing. I think the barrister i used at the 1st hearing was not prepared properly and i want to change her. Please any recommendations will be very appreciated.

Does your solicitor have any views? What chambers did they use? Barristers get details (bundles) from the solicitor. Sometimes these are very very late. Did this happen? Barristers can talk to you and your solicitor to prepare. Did this happen?

Yes, i have a solicitor and for the 1st hearing he sent me some profiles of barristers. He recommended a woman but i am not happy with her. She sent me the draft for the court for my approval in the same day of the hearing 5 hours before the hearing. Then, around 40 min before the hearing she realised she had not sent the documents to the judge. Then,in the hearing she couldn't answer all judge questions.

Thanks

So the barrister might have got the bundle from the solicitor very late? That’s not unusual. Was she from a recognised family set?

TizerorFizz · 14/07/2023 14:28

Are you in London?

Bromley , Greater London

She sent me the draft for the court for my approval in the same day of the hearing 5 hours before the hearing.
This is normal if your solicitor hands over the bundle late.

Then, around 40 min before the hearing she realised she had not sent the documents to the judge.
This isn't normal. However judges are use to getting paperwork late.

Then,in the hearing she couldn't answer all judge questions.
The barrister can only answer from the documents they are given in the bundle.

I can very much recommend my financial barrister but not the child arrangements barrister. She was ill prepared and despite me having requested an all day case conference for preparation (which I knew would be essential) she seemed to be unable to understand the case my ex would raise. How can you counter arguments if you are not prepared properly. Supposedly a top barrister for private law childrens matters. I dont believe a single review now.

TizerorFizz · 14/07/2023 15:09

Define “top”. A silk? Probably not. How much were you prepared to pay for an all day conference?

Often family barristers are pragmatic. They cannot wave a magic wand.

This case will be new to another barrister. She maybe hard to pick up the threads? Was she from a family set? Or an ad hoc one? Often it’s the solicitor who doesn’t brief well enough.

Sorry - missed Bromley! Any London set then within budget. More recently called barristers are often cheaper! For obvious reasons.

TizerorFizz · 15/07/2023 16:02

@Nousese London family chambers won’t have an issue with going to Bromley. What chambers did your solicitor recommend? What daily fee did you pay? Did you check out the specialisms of the barristers yourself? It’s very easy to do.

Nousese · 15/07/2023 16:57

My solicitor sent me the profiles from barrister from the below;

29 Bedford Row www.29br.co.uk
1 GC Family Law www.1gc.com
1 Kings Bench Walk www.1kbw.co.uk

I checked them and i asked my solicitor to recommend me on that he has work with before. At the end he recommended me this womAn name is Charlotte Street at Pump Court Chambers. he said she was very fierce but i found her not organise as I mentioned before. I booked her well in advance as my solicitor said she gets book quickly. From her profile she is not just specialised in childcare care works on other things too. I had a conference call with her and my solicitor a week before the hearing and even in this call i felt she was not prepared. I asked about something if has read it and then she didn't know what i was taking about and my solicitor pointed out to her in the bundle. I am really worried not sure what to do if she is supposed to be good but she is not prepared? I paid her 2000£. Also, sometimes i think already she knows the case might better to keep her. However if she doesn't prepare her notes to defend me? I sam my ex barrister younger and with her notes she told the judge what they wanted one by one. When the judge ask my barrister tell me what you have to do, she didn't have her bullet points. So just thought from the top of her head

She’s a leading junior barrister and been doing the job for 20 years plus. I think there must be more to this. She’s in the Legal 500 so respected. I would get your solicitor to speak to the Family Clerk at Pump Court and see who else might suit your case.

TizerorFizz · 15/07/2023 17:07

I have PMd you. Please keep what I have said confidential. I would keep her as she knows the case.

Nousese · 15/07/2023 18:28

Sorry did you mean you sent me a personal message? Where can i see it please?

Thanks
