Personal Injury Claim

I have recently sustained a fracture to my foot after I experienced a fall near my home. The pavement is uneven and has holes in the tarmac. The kerb is higher than average and below this is a drain which is sunken (making the step down even greater). I fell down the kerb and broke my ankle.

I am in a cast and signed off of work for the foreseeable. I do still get paid but I will not get my additional unsociable hour pay that I would get if I was at work, therefore I am worse off financially. I also can’t properly care for my two young children or drive.

Is it worth perusing a personal injury claim against the council regarding the improperly maintained road/pavement/drain? Has anyone experienced similar and could advise me?

Had not previously been reported to the council as a hazard? If they were aware and did nothing you can submit a claim. However it sounds like you have not suffered a financial loss (not sure a discretionary amount would be viewed as such) unless you have paid fir extra childcare etc.
