Child Maintenance

My son has been sent a claim for Child Maintenance from the CSA. He ex girlfriend has a child who is 2 years old. The mother was 26 weeks pregnant when she met my son. They split when the child was just 2 years old.
Am I right in thinking that he doesn’t have to pay maintenance?

He can contest parentage and a DNA test will be ordered. If the child is his then your son will be liable to pay back the cost of the DNA test. If he isn't, nothing to worry about.

If it’s his child / children then yes, if he doesn’t think the new baby is his then he will have to take a paternity test once baby is born.

Is it definitely for his ex’s child who is now over 2 or could it relate to another child?

Re the ex’s child, no he wouldn’t have to pay cms if a paternity test showed the child was not his

No it’s definitely the 2 year old, there are no other children.
I’ve advised him to ring them first thing tomorrow and deny parentage and ask for a DNA test.

Thank you for your replies, I thought I was correct in my thinking.

No I’m not even sure how that would work tbh if he is not the father then no he can’t be expected to pay.
