How to legally check someone is not being harassed?

Hello,

My (f) partner was sexually and racially harassed at work and since left the company. Regarding civil law there was a settlement with non-disclosure and non- disparagement agreements. Regarding criminal law a police report has been filed and proceedings would require more evidence - at least another victim/witness to come forward.

The accused has now moved to another company. Looking at the company website I can see there are two employees who fit the demographics of my partner, and I am concerned he may target them.

Please can you tell me how to legally check these two employees are ok? I understand I need to make sure that I am not legally harassing the accused.

You can't. And if she settled with a non-disclosure and non-disparagement agreement, she really can't do anything else; and it's very likely that her agreements also covered you, so you need to be really careful what you do or she may have to pay back her settlement.

The only thing you can do is make the police aware of your concerns, but they will assess whether they have enough information to act, and again - by disclosing, you need to be careful of the terms of what your partner agreed, so you may want legal advice before you do so.

Just to clarify:

  1. Regarding the settlement the only limitation regarding me is that my partner is not allowed to direct me to say anything about the allegations to anyone (and she hasn’t done so). However I know all the details and evidence because I was helping with the case before the settlement was drafted. I have not signed anything.
  2. My partner can speak to the police (in the UK all such settlements now do not restrict contact with police, doctors, lawyers and industry regulators) but I am sure the Police will not spend time on checking these people are ok - the Police refused to check if the accused had harassed at an earlier employer despite him having admitted that he had to leave it because he ‘annoyed people’)
